Dear (Representatives Title & Name),

I am a registered voter who lives in your election district.  I'm writing to inform you that I STRONGLY SUPPORT an avenue for
New York State Pistol License holders who live in
Your County and throughout the state, the ability to acquire an Unrestricted Pistol License as granted by our Counties 2nd Amendment in the Bill of Rights.

New York State issues 3 types of pistol licenses (Carry Concealed, Possess on Premises, and Possess / Carry During Employment).  Nowhere in Article 400 of New York State Penal Law (Licensing and Other Provisions Relating to Firearms) does it mention that licensing officials are able to add their own restrictions to any of these 3 types of licenses.  New York State licensing officials who deny anyone a pistol license must show, "good cause" for doing so.  Reasons for denial generally include criminal convictions, suspicions of domestic violence, or falsifying information on the application etc...  Citizens who are approved for a New York State pistol license have proven to be responsible and of moral good character.

For decades many of New York State Pistol Licensing Officials have decided by default to apply their own, "restrictions" to NYS Carry Concealed Licenses.  For decades Your County residents have been treated like second class citizens within New York State.  We are surrounded by other Counties who either issue unrestricted pistol licenses right from the beginning, or offer an educational avenue for their citizens to acquire one.  A resident of another New York County with a similar background to myself can and will be issued an unrestricted pistol license, when I can't be.  They can go out to a restaurant within Your County and sit next to me at dinner with their CCW, while I'm denied the same exact constitutionally granted freedom and right to protection.  This undeniable bias influencing the past licensing officials decisions on behalf of New York State and Your County has to change!

If the people of our great nation wish to negate the right to bear arms, we will create and vote for a 28th Amendment repealing the 2nd Amendment.  Until then, which of the words included in the 2nd Amendment is confusing to our Lawmakers and Officials?  NONE!  "The Right Of The People To Keep And Bear Arms, Shall Not Be Infringed"  Simple... Clear... Straight to the point...  You have sworn an oath to serve the people, and to uphold the Constitution of the United States.

Knowing that most decisions are based on case law, I'd also to highlight a particular case for you to research and take into consideration:
The Matter of Chwick v Mulvey - 2010 NY Slip Op 09911.  The opinion of the court states, "If each of New York's 62 Counties enacted ordinances that placed additional restrictions on licenses, as the amended ordinance effectively does, the uniformity in firearm licensing that the Legislature intended would be destroyed."

As one of your constituents, I would not only like for you to know my position on the subject, but I would like to know yours as well.  Please respond with your official stance on wether you believe Your County & New York State residence of good moral character should be allowed to be possess an Unrestricted Pistol License.

Thank you for your time and I look forward to your prompt reply.

Regards,

Please feel free to copy the following letter to send to your Elected Representatives.

Let your Elected Representatives know that as one of their VOTING constituents, you STRONGLY SUPPORT a well educated public that can possess an Unrestricted New York State Pistol License.  Let them know that your county just like every other county within New York State has to treat the issuing of
"New York State" Pistol Licenses in a non bias and "UNIFORM" manor.

Matter of Chwick v Mulvey:

" If each of the New York's 62 Counties enacted ordinances that placed additional, Restrictions on licenses, as the amended ordinance effectively does, the Uniformity in firearm licensing that the legislature intended would be destroyed".

Why is it that if we lived in a different County within "New York State" our, "New York State" Pistol License would be treated differently?  Isn't that the definition of, "Arbitrary and Capricious"?
